Please read these Terms of Service (“Terms”) carefully before using Spatiorama. These Terms form a binding agreement between you (“User,” “you”) and Spatiorama (“Spatiorama,” “we,” “us,” “our”). By downloading, accessing, or using the Spatiorama iOS application, the website at spatiorama.com, or any related services (collectively, the “Service”), you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree to these Terms, do not use the Service.
1. What Spatiorama Does
Spatiorama lets you turn photos, sets of photos, panoramas, videos, or text prompts (“Inputs”) into explorable, interactive 3D spatial experiences (“Spatioramas”). To generate a Spatiorama, your Inputs are sent to and processed by a third-party AI provider, World Labs Technologies, Inc. (“World Labs”), whose Marble spatial-intelligence models generate the underlying 3D world. Section 6 below explains this in detail — please read it before uploading anything.
2. Eligibility
Must comply with world labs ToS.
3. Accounts
You create a Spatiorama account using Sign in with Apple. We do not offer email/password sign-up. You are responsible for:
- keeping your Apple ID credentials secure and for all activity that happens under your account;
- ensuring any information associated with your account is accurate; and
- notifying us promptly at support@spatiorama.app if you suspect unauthorized access to your account.
We may suspend or terminate your account as described in Section 14 (Termination).
4. Your Inputs and Content
“Your Content” means any Inputs (photos, image sets, panoramas, videos, text prompts) you upload, and any Spatioramas, exports, or other outputs generated from them.
4.1 Your responsibility. You represent and warrant that:
- you own Your Content or have all rights, licenses, consents, and permissions necessary to upload it and to have it processed by us and by World Labs;
- if Your Content depicts other identifiable people, places, or property, you have the right to share images of them and, where applicable, their consent;
- Your Content does not infringe any third party’s intellectual property, privacy, publicity, or other rights; and
- Your Content complies with Section 5 (Acceptable Use) below.
You are solely responsible for Your Content and for the consequences of uploading, generating, or sharing it.
4.2 License you grant us. You grant Spatiorama a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display Your Content solely as needed to operate, provide, maintain, and improve the Service — including transmitting it to World Labs for 3D generation as described in Section 6.
4.3 Ownership of outputs. As between you and us, you retain ownership of the Spatioramas generated from your own Inputs, subject to (a) any rights World Labs holds or reserves under its own Terms of Service (see Section 6), and (b) the limited license you’ve granted us in Section 4.2 to operate the Service. We claim no ownership over Your Content or the Spatioramas generated from it.
4.4 We may remove content. We may remove or disable access to any of Your Content, and suspend or terminate your account, if we believe in good faith that it violates Section 5, these Terms, or applicable law.
5. Acceptable Use
You agree not to use the Service to create, upload, store, or share Inputs or Spatioramas that:
- are illegal, or that infringe someone else’s intellectual property, privacy, or publicity rights;
- depict a real, identifiable person without their knowledge and consent, particularly in a sexual, degrading, or misleading way;
- contain child sexual abuse material or any content sexualizing minors, in any form — this is never permitted, and we will report violations to the relevant authorities;
- depict non-consensual intimate imagery (“revenge porn”) or sexually explicit material;
- contain hate speech, harassment, threats, or content that incites violence;
- contain malware or attempt to interfere with, reverse-engineer, or gain unauthorized access to the Service, World Labs’ systems, or Apple’s systems;
- impersonate any person or entity, or misrepresent your affiliation with any person or entity; or
- otherwise violate World Labs’ Acceptable Use Policy, since your Inputs are processed through their platform and remain subject to their policies as well as ours.
Violation of this section is grounds for immediate suspension or termination of your account without a refund of unused credits.
6. World Labs — Third-Party AI Processing (Please Read)
Spatiorama does not generate 3D worlds itself. When you submit an Input, we send it to World Labs, via their API, to generate the resulting Spatioramas. This means:
- World Labs processes your Inputs. Your photos, images, videos, panoramas, and text prompts are transmitted to World Labs’ servers for processing, and the resulting 3D assets (e.g., SPZ/PLY files) are returned to us to deliver your Spatiorama.
- Your Inputs are subject to World Labs’ own policies. World Labs processes this data under its own Terms of Service and Privacy Policy, which apply independently of these Terms. We encourage you to read them, particularly the sections on User Submitted Content, AI model training, and data retention.
- World Labs may use your Inputs to improve its AI models. As of the date of these Terms, World Labs’ policies permit it to use content submitted through its API — including via Spatiorama — for AI model training, benchmarking, and technology development, unless and until we, as the API account holder, opt Spatiorama’s account out of that use. We have not opted out of this at this time, meaning your Inputs may be used by World Labs to train or improve its models. We will update this section and our Privacy Policy if that changes.
- We are not World Labs, and we don’t control their systems. We are not responsible for how World Labs stores, secures, retains, or uses data once it’s on their systems, except to the extent required by applicable law. If World Labs experiences an outage, security incident, or changes its API or policies, that may affect your ability to use Spatiorama, and we are not liable for World Labs’ acts or omissions.
By uploading an Input, you consent to it being transmitted to and processed by World Labs on the terms described above and in World Labs’ own policies.
7. Credits, Purchases, and Subscriptions
7.1 How credits work. Generating a Spatiorama and certain other features (e.g., high-quality mesh export) cost credits. New accounts receive a welcome grant of credits. You can obtain additional credits by (a) purchasing a credit pack, which does not expire, or (b) subscribing to a monthly plan, whose unused credits roll over up to your plan’s stated allowance.
7.2 Payments through Apple. All purchases are processed through Apple’s In-App Purchase system. We do not collect or store your payment card details — Apple handles billing, and your purchase is also subject to Apple’s Media Services Terms and the App Store’s refund policies. Requests for refunds must generally be directed to Apple, not to us.
7.3 No refunds for used credits. Except as required by applicable law or Apple’s policies, credits are non-refundable once spent, and purchased credit packs and subscription payments are non-refundable once the billing period has started.
7.4 Changes to pricing. We may change credit costs, pricing, or what features cost credits at any time, effective for purchases made after the change is posted.
8. Sharing, Links, and Visibility
Every Spatiorama is unlisted by default: it is reachable only through a unique, hard-to-guess link, and is not indexed, listed, or searchable by us or through search engines. Anyone who has that link can view the Spatiorama in a browser without installing the app. You are responsible for who you share your link with — if you share it publicly or with someone else, they can view (and potentially re-share) that Spatiorama. We are not responsible for content accessed through a link you or another user has shared.
9. Exports
Spatioramas can be exported in SPZ and PLY formats. Higher-quality mesh exports are available as a paid add-on, billed in credits, and are cached after the first export for a given Spatiorama so you aren’t charged again for re-downloading the same export.
10. Intellectual Property in the Service
Aside from Your Content, the Service — including the Spatiorama app, website, logos, and underlying software (but excluding World Labs’ own models and technology, which belong to World Labs) — is owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service except as expressly permitted by these Terms or by law.
11. Third-Party Services
The Service relies on infrastructure and services we don’t control, including:
- World Labs, for 3D world generation (Section 6);
- Apple, for app distribution, Sign in with Apple, and in-app purchases; and
- Cloudflare, for web hosting, content delivery, and security.
Your use of the Service is also subject to Apple’s own terms governing App Store apps. We are not responsible for outages, errors, or data handling by these third parties beyond what applicable law requires of us as their customer.
12. Disclaimers
THE SERVICE, AND ANY SPATIORAMAS OR OUTPUTS GENERATED THROUGH IT, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT GENERATED SPATIORAMAS WILL MEET YOUR EXPECTATIONS, BE ERROR-FREE, OR ACCURATELY REPRESENT YOUR INPUTS, AS AI-GENERATED 3D RECONSTRUCTION IS INHERENTLY IMPERFECT.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPATIORAMA AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
14. Indemnification
You agree to indemnify and hold Spatiorama harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) Your Content; (b) your violation of these Terms; or (c) your violation of any third party’s rights.
15. Termination
You may stop using the Service and delete your account at any time by contacting support@spatiorama.app. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you’ve violated these Terms, to comply with law, or to protect the Service or other users. Sections 4.3, 10, 12–14, and 16–18 survive termination.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we’ll update the “Last Updated” date and, where appropriate, provide additional notice (e.g., in the app or by email). Continued use of the Service after changes take effect means you accept the updated Terms.
17. Governing Law and Dispute Resolution
17.1 Governing law. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where mandatory consumer-protection law in your country of residence provides otherwise.
17.2 Agreement to arbitrate. You and Spatiorama agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies. This means you and we are each waiving the right to a jury trial and the right to participate in a class action, collective action, or representative proceeding.
17.3 Opting out. You may opt out of this arbitration agreement by sending written notice to support@spatiorama.app within 30 days of first accepting these Terms, stating that you decline to be bound by the arbitration clause. If you opt out, disputes will instead be resolved exclusively in the state or federal courts located in Delaware, and you and we consent to personal jurisdiction there.
17.4 EU/consumer carve-out. If you are a consumer residing in the European Union, United Kingdom, or another jurisdiction whose law grants you the right to bring claims in your local courts or gives you other mandatory protections regardless of this clause, nothing in this Section 17 removes those rights, and this arbitration clause applies only to the extent permitted by that law.
